FAILS TO PROTECT GIRLS!
POLICY 2432 – KEY FAILURES
- NO DEADLINE – There is no deadline for the process to be completed or actions to be implemented.
- EXPOSES MINORS TO COERCION – It fails to protect a minor and honor parental rights by permitting school officials to meet with and influence the minor with no parent present!
- SEEKS ALTERNATIVES TO THE LAW – It asks the minor or parent for resolution input – even though the removal of the biological boy is what the law requires.
- NO PUBLIC TRANSPARENCY – There is no public record of the grievance being filed, so there is no process transparency for constituents = no accountability. No one is expecting names to be released to the public, but voters and parents should be made aware that a grievance was filed, and for what team!
- NO COMMITMENT TO ACTION – There is no commitment to implement any recommendation or to remove a boy from a female-only sport.
WHAT’S AT STAKE
- INTEGRITY & OPPORTUNITY – Biologically boys will almost always beat girls at most physical sports, with few exceptions! Boys will take away opportunities for girls to be champions! This has already occurred at other levels.
- SAFETY – There is a statistically significant risk that the strength of boys will cause injury to girls. It has occurred at other levels, and it can be life-changing. Let’s not let that happen here.
- SEEKS ALTERNATIVES TO THE LAW – It asks the minor or parent for resolution input – even though the removal of the biological boy is what the law requires.
- PRIVACY & SEXUAL ABUSE – Blurring the lines of male and female will, and has already in other parts of the country, led to rapes and harassment in female facilities by biological boys.
BRIEF HISTORY – 2023
- The superintendent, board members, and their legal team, drafted and adopted policy 2432 in 2023 relating to HEA 1041 – which in concept requires Indiana public schools to have a grievance policy for a girl to report that a boy is playing on a female-only sports team.
- School officials themselves entitled it the “transgender policy” – in effect, that is who it protects
- The policy did not get public readings, nor did the board seek public input.
- The superintendent, Teresa Gremaux, has attempted to claim in a board meeting that this did get a public reading, but that is very misleading. It was not read aloud to the public, nor were copies provided during the “working sessions” where it was cryptically discussed. Engage East Noble has all of these sessions recorded to back up this claim.
- The board and superintendent rejected repeated requests from the public for copies of the proposed policy, and they refused to answer some questions until after the policy was adopted. The proposed policy was not released to the public until shortly before the vote when there was little time for the public to understand it and ask questions.
- The public gently and respectfully asked the board to delay the vote 30 days to consider concerns about process gaps in the policy. They refused to do so. The superintendent was quick to point out soon after the vote that “we have no intention to add to the policy”.
- The board member who claims to have been key in the development of the policy, Faye Kline, will not reasonably discuss the weaknesses of it and what needs to be fixed. She will not reply to requests to discuss the policy’s process weaknesses. We would be delighted to remove this criticism with a simple discussion.
- The board repeatedly says that the policy is legal, and won’t hear concerns that bad processes can still be perfectly legal.
IMPORTANT OBSERVATIONS
- SUPPORTED BY THE LEFT – It faced no known opposition from trans-activists in the community or at school board meetings – in fact, they repeatedly expressed support for the board in each meeting during this time, and right after the adoption of the policy
- KNOW THEM BY THEIR FRUITS – The points made in the history section above where the board refused to delay the vote, refused to share drafts, refused public readings, and refused to transparently answer our questions – are all we need to know about their hearts on this matter. They refused to be transparent, they refused to be reasoned with, and they refused respectful requests for 30 days to address process gaps.
